Terms and Conditions

Before booking, please review the Booking Conditions, which outline your legal rights and obligations: 1. Contract Your booking contract is with Mad Expeditions, LLC acting as an agent for its suppliers. By booking, you agree to be bound by these Booking Conditions, Important Notes, and any Special Conditions, which together form the entire agreement. References to "you" and "your" include the primary booker and all persons listed on the booking. While the contract is between you and Mad Expeditions, LLC, you may see the names of suppliers in trip documentation. 2. Privacy Policy Your personal information will be handled in accordance with our Privacy Policy. It is your responsibility to review the policy periodically for any updates. 3. Deposit Requirement A non-refundable deposit of $500 per person is required to confirm your booking, unless stated otherwise. The deposit amount may vary for certain trips or special promotions and will be communicated accordingly in the Special Notes. If booking within 60 days of departure, full payment is required at the time of booking. 4. Acceptance of Booking and Final Payments A contract is formed when we issue your booking confirmation invoice or accept your payment (if booking within 60 days of departure). Final payment is due 60 days before departure, unless stated otherwise. Failure to pay on time may result in cancellation and applicable cancellation charges. 5. Booking Review Process All bookings are manually reviewed. Please allow up to 48 hours for us to process and confirm your booking. 6. Prices and Surcharges Trip prices may vary based on demand, availability, and market conditions. Prices confirmed at booking may differ from later prices. Any reduced pricing or discounts after confirmation are subject to full cancellation conditions. We may apply surcharges up to 60 days before departure due to changes in exchange rates, transportation, or operator costs. If a surcharge exceeds 10%, you may cancel within 14 days for a full refund. Credit card payments may incur additional charges. 7. Payment Processing Payments will be processed through “Square” and will appear as the payment processor on your credit card statement. Please note that any fees for processing credit cards will be added to your final invoice. 8. Partner Suppliers The agency works with third-party suppliers (tour operators, hotels, etc.) to provide services. While your contract is with Mad Expeditions, LLC, you may see the names of these suppliers in trip details. In case of issues or emergencies while traveling, please reach out directly to our agency for assistance rather than contacting the suppliers directly. 9. Surcharges We may apply surcharges up to 60 days before departure due to changes in exchange rates, transport costs, taxes, or government actions. We cover up to 4% of the trip price, with you responsible for the balance. If a surcharge exceeds 10%, you can cancel within 14 days for a full refund. Credit card payments may incur additional fees. 10. Your Details To confirm your booking, you must provide necessary details, such as full name and medical conditions. We will reach out to request passport details, including number, nationality, issue and expiry dates, for travel purposes. For some trips, a Self-Assessment form may also be required. Refer to our Privacy Policy for information on how your personal details are handled. 11. Cancellation by You Cancellation fees are as follows: • 60+ days: Deposit held as credit. • 31-59 days: 30% of total cost. • 15-30 days: 60% of total cost. • 14 days or fewer: 100% of total cost. Deposit credit can't be used for the same or similar dates. Cancellation policies may vary, and we recommend insurance. No refunds for unused services or early departures. 12. Cancellation by Us Trips are guaranteed once fully booked, except where specified. If we cancel, you can transfer payments to another departure date or receive a refund, except in case of a Force Majeure Event. 13. Force Majeure Cancellation In the event of a Force Majeure (e.g., natural disaster, pandemic), we may offer: • A 100% credit, or • A refund minus unrecoverable costs. If the event occurs during the trip, we offer a pro-rata credit or refund for unused days. No refunds for incidental expenses (e.g., visas, flights, insurance). 14. Credit Any issued credit has no expiry date, is non-transferable, and cannot be redeemed for cash or used for flights/insurance. 15. Booking Amendments Amendments or transfers are subject to availability and may incur fees. No changes are allowed within 65 days of departure. 16. Inclusions The land price includes accommodation, transport, meals, sightseeing, and group leader services, as outlined in the Essential Trip Information. 17. Exclusions The land price does not include: • International or internal flights, unless specified • Airport transfers, taxes, or excess baggage charges, unless specified • Meals not listed in the Essential Trip Information • Visa and passport fees • Travel insurance • Optional activities and personal expenses 18. Age & amp; Health Requirements Age requirements will be included in the essential notes, as they may vary by local tour operator. For most adventure travels, the minimum age is 15. Please check with us to confirm details and ensure everything aligns with your preferences. Travelers under 18 must be accompanied by a legal guardian or designated escort. Please reach out for more information. No upper age limit, but travelers must be fit for the trip's physical demands. Consult a medical professional for health advice and requirements prior to booking. 19. Additional Terms Some trips may require you to sign additional waivers or release forms. If required, these must be signed to participate in the trip. 20. Passport & Visas You are responsible for obtaining all required documentation, including a valid passport (6 months validity after the trip), visas, and insurance. Any costs due to missing or incorrect documents are your responsibility. 21. Travel Insurance Travel insurance is mandatory and must be purchased at the time of booking. It must cover medical emergencies, repatriation, cancellation, liability, and loss of luggage. You must provide your insurance details on the first day of the trip. Without this, you cannot join the trip. 22. Change of Itinerary Itineraries may change due to local circumstances. • Before departure: Significant changes (affecting at least one day) will be communicated. You may accept the change, request a refund for the land portion, or choose an alternative trip. • After departure: Changes may occur due to local conditions or emergencies. Additional costs will be covered by you. We are not responsible for incidental expenses from itinerary changes, such as visas, vaccinations, or non-refundable flights. 21. Optional Activities Optional activities not included in the trip price are not part of this contract. Any assistance or recommendations from the group leader or local representative does not make us liable for these activities. The contract for these activities is between you and the provider. 22. Claims & amp; Complaints If you have a complaint, inform the group leader or local representative immediately so they can try to resolve the issue. If unresolved, submit your complaint in writing within 30 days of the trip’s end via our contact form page. 23. Severability and Enforceability If any part of these Booking Conditions is unenforceable, it will be severed or amended to allow the remaining terms to remain in effect. 24. Applicable Law These Booking Conditions are governed by the laws of Victoria, Australia, and do not affect your rights under local consumer laws. 25. Assignment We may assign our rights or obligations under these Booking Conditions, including to a related body corporate, with written notice to you. 26. Promotional Terms Promotions on our website are subject to these Booking Conditions and additional terms specific to each offer. Promotions are available for a limited time and may be canceled or changed. By booking a promotional trip, you agree to the applicable terms.

How We Use Your Information We collect and use your personal data for the following purposes: • To process and confirm your bookings • To provide you with trip details, itineraries, and updates • To communicate with you about your travel arrangements and respond to inquiries • To ensure your safety during travel, including informing relevant service providers of any special requirements or medical needs • To comply with legal and regulatory obligations 3. Merchant of Record and Payment Processing The Merchant of Record for all payments made through our platform is Square. We work with trusted third-party payment processor Square to securely handle your transactions. Square uses secure methods to process your payment and maintain your financial data. We do not store sensitive payment details (like credit card numbers) directly on our systems. Payments are processed via our secure payment gateway, and your personal information will be shared with this provider solely for the purpose of processing payments and completing your travel arrangements. 4. Data Sharing and Security We respect your privacy and do not sell, rent, or trade your personal information to third parties. However, we may need to share certain information with trusted partners and service providers (e.g., airlines, hotels, tour operators) who are involved in providing your travel arrangements. These third parties will only use your data to fulfill their responsibilities related to your trip. We maintain reasonable safeguards to protect your personal data from unauthorized access, disclosure, alteration, and destruction. This includes secure payment processing via trusted payment gateways. 5. Retention of Data We will retain your personal data only for as long as necessary to fulfill the purposes outlined in this policy, or as required by law. 6. Your Rights You have the right to access, update, or request the deletion of your personal data. If you wish to exercise these rights or have any concerns about how your data is handled, please contact us. 7. Use of Photos and Videos Any photos or videos we take during your trip may be used for promotional purposes, such as on our website or social media. If you would prefer not to have your likeness used in such materials, please inform us before or during your trip, and we will ensure you are not featured. 8. Updates to This Privacy Policy We may update this Privacy Policy from time to time. Any changes will be posted on our website, and the revised policy will apply to all personal information we hold. By booking with us, you consent to the collection, use, and processing of your personal data, including photos and videos, as outlined in this Privacy Policy. Additionally, you consent to the processing of your payment information through our payment gateway and our trusted partners and agents involved in providing your travel arrangements.
